Subframe Issues

Hey guys......first post on what could be the eve of my first ever BMW purchase. Im going to look at a 2000 328 Tourer tomorrow , and wondered if this subframe issue effects the Tourer as well ?

Cant seem to find and definate info.

Hey everyone, sorry to post a question as my first post but was wondering about this problem with the rear subframe mounting points im looking to buy either a 328 or 323 (2.5) and when i go to look at the car would it be worth using this as a bargaining tool? :)

i can only really afford a 1999 to 2001 and would really like to know if its worth the hassle as knowing my luck it will go if its not already been done,

would there be some sort of documentation in the history if its been done etc

other wise ill have to get a 530 lol

Unfortunately my first post here is not a merry one, but one of woe and a subframe failure. But I have just got back from the local dealer who is sending the pictures off to BMW, so I am sat here with everything that is physically possible to cross, crossed - especially considering it is on an 99S plate.

The chap did say however, even though it was one of several they have done, he had never seen it tear where it had. He said that he had only ever seen it tear on the front mounts, and mine was the first he has seen tear on the rear.

I assume I will be getting a call within the next day or two from BMW and from the dealers, do I need to keep hassling them? Any tips for when I do?

Check out the DIY section mate, there is a DIY on this should BMW not honour the claim, they will not under any circumstance honour this for a car over 10years old like mine........so if its a 99 your knackered basically ;)

Spent a good deal of time on the phone to BMW this last few days pressuring them about this.

Sadly my DIY is for the front mounts, but should be similar procedure for the rears.

We got ours back from BMW last week and got to say it feels so nice and tight again!

After giving the loan 1.2 Fiesta back and getting in the BMW, felt like a new car even though its 8 years older and nearly 100k more on the clock!! So quiet and refined, so now the subframe has been done we've decided to keep it to, as to much time and money has gone into the car to sell for peanuts!

As predicted BMW have said no but I got the contact at BMW GB so will be giving them a call tomorrow. Anyone got any tips for this? haha

The total for the estimate is 3,143.17, so seems about average for what has been posted on here.

Have the garage indicated how long its been like it? If you can get the garage to agree its been 6months + they may agree to it. But it'd take some arguing.

I'd also push the fact its been like it for a while, you had a indie look at it last year and its taken you a while to get BMW to. It's not like its 3 years past...

I spoke to BMW yesterday and was told that if the car was one week over the 10 years they wouldn't even consider it. But to get this in writing I need to send them a letter first.

Absolutely mate, will be getting hold of Autocar and Auto-Express, tried the other day but answer machines, told BMW I would spread this as far as I can in the media......

Why not get Bmw car club to fight your corner, they were prepared to do it for me if Bmw declined my subframe problem?

I had a quick look under mine when it was up on the ramps for MOT and could not see anything obvious, although im not 100% where i should be looking. Are there any diagrams/pics/videos outlining where the stress cracks occur? My car is a 2001 model, so i need to get it sorted fast if mine is suffering.

Ive seen some people mention that BMW will inspect it for free... would they inclined to say there is no damage if they know full well they will be footing the repair bill?

Am I right in saying that BMW are 100% not repairing these cars if they are over ten years old?

I thought it was just me this was happening to and I fought it quite hard quite high up the tree in BMW UK.

Short of going to a lawyer(how much would that cost?!?) they are not going to repair mine. Would be interested in hearing if anyone has had it fixed recently when the car is over 10 years old and how they managed it.

I think this is a disgrace especially since they settled the law suit in America.

Does anyone know of an indy who can do this repair either in Scotland or North of England? Mines is due an MOT in July, the car feels ok but doubt whether it will pass or not.

No, they're not interested in stuff over 10 years old. And why should they be? It's over ten years old! If you look in any scrapyard, you'll see 1999 Mondeos, Vectras and stuff like that. To them it's an old car now and I wouldn't expect Ford to fix a 1999 Mondeo for free.

They will just laugh at you if you 'go to the media'. "ELEVEN YEAR OLD BMW HAS CRACK IN BOOT FLOOR!". Yeah, and so what? It's old so what do you expect? Be realistic!

Also, BMW are no longer replacing boot floors - it's the weld on repair panel now which is still a rear suspension out job.

Difference is those Mondeos and Vectra's cost nearly half the price of a decent 3er, and the only reason they are probably in the scrappy is because of a mechanical failure not a total STRUCTURE failure which is what happend with the E46.

I own a BMW 328i, registered 2000 and have currently clocked up 117,500. I noticed the dreaded noise from the back about a month ago and took it to my local garage, Highams Park Motor Company who I have been getting my car serviced through since I purchased in 2005 as they come highly recommended. They realised the problem straight away and sent me to Sytner in Chigwell where pictures were taken and sent off to BMW UK. I have since had the following response back from the head of customer services:

I am in receipt of your email dated June 9, 2010, received by Tim Abbott, the contents of which have been noted. Your correspondence although read with interest by our Managing Director, has been passed to me for response, as I am responsible for responding to all customer service issues that may arise from your particular area of the United Kingdom.

Having read your correspondence I was sorry to note the concern you have with rear subframe on the above vehicle. On behalf of BMW UK please accept my apologies for the disappointment this has caused. Your vehicle is 125 months old with a mileage in excess of 117,000 miles and has not been supported by a BMW Warranty since January 2003. It has also not been seen in our dealer network since July 2003 with a recorded mileage at that time of 46,967.

BMW UK do implement a post warranty goodwill policy, but there are limitations, one of these are that we do not offer goodwill when a vehicle has attained 72 months of age. We are also unable to review goodwill on a vehicle that has not been seen in our dealer network for seven years, as we have no record of where the vehicle has been seen or what works have been carried out during that period of time.

In closing, I am sorry you have found it necessary to contact our Managing Director and that my response could not have been more favourable.

I am reviewing my options and am in the process of taking legal advice but I want to find out information from people who have had their problem fixed or who have had it refused. In terms of people who have had it fixed, how old was their car, mileage, full BMWSH, etc. so I can out a proper case together.
