Do I Have A Leg To Stand On?

Had the police out on Thursday, gave a statement etc, didnt really seem tat bothered to be fair!

Told me ill not really hear anything back untill mid jan, and even then, if they cant find out who it was its tough basically!

Oh how i love how this country is run! Been paying 10's of thousands of pounds over the years for insurance, and the one time i actually need it its useless as im not fully comp! Such a pathetic system!!!

My opinion is that although he caused you to slam on your brakes, you should have just hit him instead of saving his van at the expense of your car. It's unlikely that you'll get anything out of Royal Mail.

You're lucky the owner of the house isn't claiming against your insurance to repair his wall...

In short no. As said by your insurance. The RM van driver is not at fault, even though he pulled out on you.

If you had hit him it then it would have.

You may be able to get a good will guester out of RM but it'll be less than likely.

Well my oh my, youll never guess who i bumped into today!!!! lol

Was bored and decided to take my Audi round the block to warm up her etc, driving up my street and who do i see, yep the same guy from the accident!!

So after a swift u turn i followed him till he stopped and made a delivery, asked him nicely if he was the guy who pulled out in front of a bmw, he then went off on one saying it was my fault and i was a liar etc!

Swiftly to him to go and fook himself, took his reg and his van number and went home! lol

Just got off the hpone to them and they already knew who it was and have spoken to him and my witness, its now been referred over to a sister company who, and get this specialise in repairs or cars!!

Im waiting to hear back from them but from the way the guy was sounding it sounds like it may get repaired free of charge, and a hire car supplied! lol

Fingers crossed eh!

Looks like things are going to turn out good for you. Bet he loved seeing you again lol. Seeing as it was his work van and all I don't see why he really cared? You're pride and joy versus his works insurance...I know what I would have done!

If you hit him on the side then you can claim from him... but if you hit him directly at the back of his van them the blame would be on you... This is because when you applied your brakes and started sliding, they would conclude that you didn't take the road conditions into consideration and was going too fast... If there willing to payout for this accident then your very lucky... :)

Another quick update!

They have accepted all liability, and just dropped off my hire car, a very flat 1.6 Focus!

Assesor coming out in the next 2 days, but the guy on the phone reckons it'll be a write off!

So what are the book values on a 330ci, fbmwsh, 110k, totally std, and in very very mint condition, oh and topaz blue?

And just to finish this thread off nicely, they've wrote the car off, and offered me £5500, considering i only paid £3500 im quite pleased!

I may be back with a 330ci sport this time with a manual, i dont know yet, still debating about what car to get next, got a nice little list going! lol
